By accessing or using this website, mobile application, or any other MMTH WEAR product or service (collectively, the “Platform”) on any computer, mobile phone, tablet, console, or other device (collectively, “Device”), you signify that you have read, understand, and agree to be bound by these Terms of Use and any applicable law, whether or not you are a registered member of MMTH WEAR.
MMTH WEAR may update these Terms of Use at any time without prior notice. Changes become effective upon posting to the Platform. Your continued use of the Platform constitutes acceptance of the revised Terms. If you do not agree to these Terms, please do not use the Platform.
Important Notice for Amateur Athletes
YOU ARE RESPONSIBLE FOR ENSURING THAT YOUR USE OF THIS PLATFORM OR PURCHASE OF PRODUCTS DOES NOT AFFECT YOUR ELIGIBILITY AS AN AMATEUR ATHLETE. PLEASE CONSULT YOUR ATHLETIC ASSOCIATION OR COMPLIANCE OFFICE FOR APPLICABLE RULES. MMTH WEAR IS NOT RESPONSIBLE FOR ANY IMPACT ON YOUR ELIGIBILITY.
Intellectual Property
All intellectual property on the Platform (excluding User Generated Content) is owned by MMTH WEAR, MMTH, or its licensors and is protected by copyright, trademark, and other applicable laws.
All trademarks, service marks, trade names, logos, and designs — including MMTH, MMTH WEAR, and related marks — are owned, registered, and/or licensed by MMTH.
All content on the Platform, including but not limited to text, graphics, photography, video, designs, code, software, applications, and interactive features (“Content”) is the proprietary property of MMTH WEAR or its licensors. All rights reserved.
Nothing in these Terms grants you any license or ownership rights in any intellectual property.
Platform Use Restrictions
You may use the Platform and its Content solely for personal, non-commercial purposes, including placing orders for MMTH WEAR products.
You agree not to:
- Modify, copy, distribute, reproduce, republish, download, display, post, transmit, or sell any Content without prior written consent
- Remove ownership or proprietary notices
- Use scraping, bots, data mining, or automated methods to access the Platform
- Use the Platform for unlawful purposes
Unauthorized use may violate intellectual property laws and other regulations.
Product Orders
All orders placed through the Platform are subject to acceptance by MMTH WEAR. We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, or product availability limitations.
If your payment method has been charged and your order is cancelled, a refund will be issued.
Returns, Exchanges & Cancellations
STANDARD PRODUCTS — 30-Day Returns
Returns must be initiated within 30 days of delivery.
Items must be:
- Unworn
- Unwashed
- Tags attached
- Items showing signs of wear, staining, alteration, or missing tags may be refused and returned to the customer.
STANDARD PRODUCTS — 45-Day Exchanges
Exchanges for size, color, or store credit must be initiated within 45 days of purchase.
Items must be unworn, unwashed, and tagged.
Final Sale
Final sale items are not eligible for return or exchange.
International orders are not eligible for return, exchange, or store credit.
LIMITED EDITION PRODUCTS
All Limited Edition products are final sale.
Due to limited production quantities and allocation management, we do not accept returns, exchanges, or cancellations for Limited Edition items.
Color Disclaimer
Product colors displayed on the Platform may vary due to differences in device screens and display settings. MMTH WEAR is not liable for minor color variations.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. MMTH WEAR is not liable for unauthorized use of your account.
User Generated Content (UGC)
“User Generated Content” includes any content you post or share on the Platform, including photos, comments, reviews, or other materials.
You are solely responsible for your User Generated Content.
By submitting User Generated Content, you grant MMTH WEAR a non-exclusive, perpetual, worldwide, royalty-free, transferable license to use, reproduce, modify, distribute, and display such content for commercial or promotional purposes without compensation.
MMTH WEAR reserves the right to remove content or terminate accounts at its discretion.
Copyright Infringement (DMCA)
If you believe material on the Platform infringes your copyright, please provide:
- Your contact information
- A description of the copyrighted work
- The location of the allegedly infringing material
- A statement of good faith belief
- A statement under penalty of perjury that your claim is accurate

Our Privacy Policy is incorporated into these Terms by reference and governs how we collect and use personal information.
Warranty Disclaimer
The Platform and all products are provided “AS IS” and “AS AVAILABLE.”
To the fullest extent permitted by law, MMTH WEAR disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, MMTH WEAR shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Platform or products.
If MMTH WEAR is found liable, total liability shall not exceed $100 USD.
Some jurisdictions do not allow limitations of liability; these limitations may not apply to you.
Governing Law
These Terms shall be governed by the laws of the State of Minnesota (or update to your actual state of operation), without regard to conflict of law principles.
All disputes shall be resolved exclusively in the state or federal courts located in [Insert County/State].

Class actions are waived to the fullest extent permitted by law.
